PROCEDURE
1) Email the ID number of the dress you would like to try-on to check availability.
2) Fill out and submit this contract.
3) The try-on fee is $70 for 1 to 2 dresses, and it increases to $140 for 3 to 4 dresses. Upon completion and submission of this contract, you authorize the processing of this fee.
4) By completing and submitting this form you automatically authorize the placing of the authorization/hold for the security deposit on your credit card prior to your dress shipment. The security deposit will be held for each dress in your possession. If the authorization/hold is declined you will be asked for an alternate method of payment before the dress(es) will be shipped. If none is provided then this contract is cancelled. When the dress(es) are returned, we will release the authorization/hold on your credit card. If for any reason the dress(es) are not returned, you loose this security deposit.

NOTE: The security deposit is to protect the financial investment for the owner of the dress. The purchase price listed on the website is the amount of the security deposit. If there is no purchase price listed, than the security deposit will be the original retail price listed on the website.
5) You are not allowed to remove the attached price tag from the dress during try-on.

1) Dresses sent for try-on must be returned within 48 hrs of receiving them. Each day past the ship date a dress is not received, you will be charged $200 late fee per day, per dress for up to 7 days. After 7 days it will be treated as a purchase and you will not receive a refund of your try-on fee, or security deposit. We will also charge the 5% credit card processing fee to your security deposit/purchase. This will apply to each dress in the shipment.
2) If the dresses are lost or stolen while in your possession, it will be treated as a purchase. You will not receive your try-on fee or security deposit back. We will also charge the 5% credit card processing fee to your security deposit/purchase. This will apply to each dress in the shipment.
3) If the dress(es) have noticeable damage, and/or a large amount of stones missing after your try-on, you will be notified and held financially responsible for up to the full purchase price of the dress, which is listed on the website, for the cost of the repairs. If it is treated as a sale, you will also be charged the 5% credit card processing fee to the security deposit/purchase price of the dress.
If the dress(es) are determined to be damaged beyond repair, you forfeit your total security deposit, and try-on fee. We will also charge the 5% credit card processing fee to your security deposit/purchase. In this instance you will also be responsible for the shipping cost back to you.
If there is no purchase price listed, then you will be responsible for up to the full original retail price of the dress listed on the website. Assessment of the damage will be at the discretion of Encore Ballroom Couture.
4) You may NOT alter any dress you are trying on! If you do, it will be treated as a purchase. You will not receive your try-on fee or security deposit back. We will also charge the 5% credit card processing fee to your security deposit/purchase.
5) CAUTION: Wash your hands before touching the dresses! Please make sure your hands are free from makeup, gels, hairspray, food, lotions, and other oils that can stain the fabric of the dress. You must shower before putting the dress on so that sweat, perfumes, glitter, tanner, bronzer, makeup, deodorant, and lotions do not come off on the dress. Please do not spray any glitter, perfume, hairspray, other fragrances, or smoke around or while trying on the dress. It is requested to help us maintain the strictest hygiene standards, that you wear panties while trying on the dress. Sit down to try the dress on, being careful with the heel of your shoe. Please be delicate with the dress while trying it on. If you are rough, stones can be knocked off. DO NOT DRY-CLEAN OUR DRESSES FOR ANY REASON!!!
NOTE: If there are any stains on the dress, you will be held financially responsible for up to the full purchase price of the dress, which is listed on the website. If there is no purchase price listed, then you will be responsible for up to the full original retail price of the dress listed on the website. Assessment of the damage will be at the discretion of ENCORE BALLROOM COUTURE LLC.

CANCELLATIONS
1) Email notification is required for all cancellations. If you cancel within 48 hours of your ship date for the try-on, then you will still be charged the full try-on fee.
CLAUSES
1) If the dress you currently have reserved for a try-on is purchased before your event, the purchase will take priority, and this contract will be void. You will be notified immediately and have the option to choose a different dress, or receive a full refund of your try-on fee, if already processed.
2) If the owner of the dress you have reserved for try-on wants it back, this contract will be void. You will be notified immediately and have the option to select a different dress or be refunded your try-on fee, if already processed.
3) ENCORE BALLROOM COUTURE LLC does not offer professional discounts on the try-on fee.
4) The try-on fee and shipping costs DO NOT go towards future rental fee or purchase of the dress.
5) ENCORE BALLROOM COUTURE LLC will not be held liable for any injury or malfunction encountered while wearing or in possession of the dresses.
6) ENCORE BALLROOM COUTURE LLC cannot be held liable for the condition of the dresses.
7) All accessories accompanying the dresses will be held to this agreement.
8) This Try-On Contract is strictly between you and ENCORE BALLROOM COUTURE LLC, others are not permitted to try-on or wear the dresses entrusted to you.
9) There will be complete confidentiality concerning all personal information provided to ENCORE BALLROOM COUTURE LLC.
10) You will pay any court and attorney costs related to legal proceedings to recoup fees.
11) Julie Wilson as Owner of ENCORE BALLROOM COUTURE LLC, reserves the right to make all final decisions in all matters concerning this company.
12) ENCORE BALLROOM COUTURE LLC abides by the rules and regulations of the State of Virginia. Any court action brought forth or involving ENCORE BALLROOM COUTURE LLC, must be presented and resolved in Fairfax County, in the State of Virginia.
